Estate Liquidation Agreement
This is a tentative contract, some terms can be different considering the cleanup before the sale and cleanup after the sale is complete.
Steam Punk Dan Estate Liquidators (SPD) agrees to liquidate agreed contents of the residence located at:
ADDRESS
- (SELLER) of the property.
(THE SELLER)
Seller warrants and guarantees they have legal authority for the listed contents to be sold and the property is free and clear of liens or other claims of ownership.
Seller agrees that the estate liquidation shall be performed on the following terms.
  1. Seller agrees that all items not to be sold under this agreement will be removed from the premises, moved to a central location, set aside in the garage, or clearly marked as NOT FOR SALE.
  2. Any items taken from the residence from the agreed list is subject to a 30% value fee from the agreed value charge listed on the agreement.
  3. (initial) Pricing will be from the agreed value list 100% first day, 75% second day, 50% off and Fourth Day 75% off the marked agreed price.
  4. Steam Punk Dan will charge 40% of the total sales receipts plus a 250 Dollar deposit. The deposit will be paid at the time of signing the agreement.
  5. Seller represents and warrants that it has Homeowners Insurance for the premises on which the estate sale is held and shall indemnify and hold harmless the Liquidator agents and employees from and against all damages to goods or injury to persons occurring or sustained on the premises.
  6. Liquidator (SPD) shall not be responsible for any theft or breakage of the property to be liquidated. The sellers shall assume all risk of loss, damage or destruction of the property from any cause whatsoever from the effective date of this agreement until the time the liquidation ends or a purchaser accepts possession of the goods.
  7. Liquidator (SPD) shall require 6 days from the final deposit of the sale to close the books and issue a certified check to close the agreement.
  8. Liquidator (SPD) shall be furnished a key to the residence and any needed access to all items on the approved list.
  9. Either or agreement: on completion of the sale (initial) Seller agrees to be responsible for cleanup of the premises, or (initial) Seller agrees to let the liquidator or his agent remove any property not sold.
  10. The laws remove of the local government and the state of Texas shall govern this agreement.
  11. This agreement may only be amended, revoked, or modified by written agreement signed by both parties.
THE SERVICES ARE PROVIDED ON A “BEST EFFORTS” BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES. LIQUIDATOR (SPD) DOES NOT GUARANTEE THAT THE SERVICES WILL RESULT IN ANY PARTICULAR OUTCOME.
IN WITNESS WHEREOF, THE PARTIES SHAVE EXECUTED THIS AGREEMENT TO BE EFFECTIVE ON (DATE)
